Terms of service
1. Scope
1.1 These Terms of Service apply to all orders placed via the online shop caminoshop.com, operated by Camino Unlimited Ltd, Centris Business Gateway, Level 4/W, Triq Is-Salib tal-Imriehel, Zone 3, Birkirkara CBD 3020, Malta, company no. C 111324, VAT ID MT31860008 ("we", "us"), in the version valid at the time of the order.
1.2 A "consumer" is any natural person who concludes a contract for purposes outside their trade, business, craft or profession. A "business customer" is any natural or legal person acting in the course of their trade, business or profession.
2. Conclusion of the contract
2.1 The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to place an order.
2.2 By clicking the button "Pay now" (or similar) at the end of the checkout process, you submit a binding offer to purchase the goods in your cart. Before submitting, you can review and correct all entries at any time.
2.3 We send you an automatic email confirming receipt of your order. This confirmation does not yet constitute acceptance. The contract is concluded when we send you a separate order confirmation or ship the goods, whichever occurs first.
2.4 The contract language is English. We store the text of the contract. Your order data and these Terms are sent to you by email, and you can view your past orders in your customer account.
3. Products, prices and payment
We sell physical goods only.
3.1 All prices include VAT. For deliveries within the EU, VAT is charged at the rate applicable in the country of delivery.
3.2 Shipping costs are shown separately in the product description, the cart and at checkout. See our Shipping Policy.
3.3 Available payment methods are shown at checkout. Payment is due immediately upon conclusion of the contract.
4. Delivery
4.1 We deliver to the countries listed in our Shipping Policy.
4.2 Delivery times are stated in our Shipping Policy and on the product pages.
4.3 If a product is unavailable through no fault of our own, we may withdraw from the contract. We will inform you immediately and refund any payments without delay.
5. Retention of title
The goods remain our property until full payment has been made.
6. Right of withdrawal
Consumers have a right of withdrawal as set out in our Withdrawal Policy.
7. Warranty (legal guarantee)
7.1 The statutory legal guarantee applies. For consumers, we are liable for any lack of conformity that becomes apparent within two years of delivery.
7.2 For business customers, the warranty period is 12 months from delivery.
7.3 Please report obvious transport damage to us as soon as possible. Failing to do so does not affect your statutory rights.
8. Liability
8.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, and where liability is mandatory by law.
8.2 In cases of slight negligence, we are liable only for breaches of essential contractual obligations, limited to the foreseeable damage typical for this type of contract.
9. Governing law and disputes
9.1 These Terms are governed by the laws of Malta, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of the country of your habitual residence.
9.2 For business customers, the place of jurisdiction is Malta.
9.3 We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. If you have a complaint, please contact us at info@caminoshop.com – we will do our best to find a solution.
